Welcome to ChatRandom. These Terms and Conditions ("Terms", "Agreement") constitute a legally binding contract between you (the "User", "you", or "your") and ChatRandom US ("ChatRandom", "we", "us", or "our"). This Agreement governs your access to and use of the ChatRandom website (us-chatrandom.com), mobile applications, video chat services, and all related software and platforms (collectively, the "Services").
BY ACCESSING, BROWSING, OR USING THE SERVICES IN ANY WAY, YOU EXPLICITLY ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. If you do not agree to every provision of this Agreement, or if you do not possess the legal capacity or authority to agree to these Terms, you are strictly prohibited from using the Services and must disconnect immediately.
1. Eligibility and Age Requirements
ChatRandom is a platform designed exclusively for adult users. The nature of random user-generated content means you may encounter material intended only for mature audiences.
- Strict 18+ Policy: You must be at least eighteen (18) years of age, or the age of legal majority in your specific jurisdiction (whichever is greater), to access or use the Services.
- Zero Tolerance for Minors: We do not knowingly permit minors to use the platform. If we discover or possess a reasonable belief that a user is under the age of 18, we will immediately terminate their connection, permanently ban their IP address, and, where appropriate or legally required, report the incident to the relevant law enforcement authorities and child protection agencies (such as the NCMEC in the United States).
- Parental Responsibility: If you are a parent or guardian and discover your minor child has accessed our Services, please contact our support team immediately. We highly encourage the use of parental control software to block access to adult-oriented or unmoderated platforms.
2. Acceptable Use and Prohibited Conduct
To ensure a safe, functional, and enjoyable environment for all users, you must abide by the following rules of conduct. You agree that you will NOT use the Services to:
A. Illegal and Harmful Behavior
- Child Exploitation: Display, broadcast, share, or request any form of child sexual abuse material (CSAM) or engage in any predatory behavior toward minors. This will result in an immediate, unappealable ban and reporting to law enforcement.
- Harassment and Threats: Intimidate, bully, stalk, harass, or make threats of violence against any other user. Hate speech, including slurs based on race, religion, sexual orientation, or gender identity, is strictly prohibited.
- Non-Consensual Content: Broadcast or share intimate images or videos of another person without their explicit consent (commonly referred to as "revenge porn").
- Self-Harm: Display or encourage suicide, self-mutilation, or eating disorders.
B. Platform Integrity and Spam
- Bots and Automation: Use any automated scripts, spiders, crawlers, or bots to access the Services, bypass our matchmaking system, or scrape data from other users.
- Spam and Advertising: Use the camera or text chat functionality to broadcast commercial advertisements, affiliate links, phishing URLs, or solicit funds (including promoting premium Snapchat, OnlyFans, or similar services).
- Impersonation: Falsely claim to be a ChatRandom moderator, an employee, or another public figure to deceive users.
3. Assumption of Risk and Peer-to-Peer Technology
ChatRandom provides a blind matchmaking service. We do not control, endorse, or guarantee the behavior of the strangers you are matched with. By clicking "Start", you acknowledge and agree to the following:
- Unpredictable Content: You may be exposed to content that is offensive, indecent, explicit, or objectionable. You use the Services entirely at your own risk. Your primary remedy against objectionable content is to immediately click the "Next" button to disconnect.
- WebRTC IP Exposure: As outlined in our Privacy Policy, our live video chat operates using Web Real-Time Communication (WebRTC) technology. Establishing a direct peer-to-peer connection requires your public IP address to be shared with the device of the user you are chatting with. Tech-savvy individuals may use this to determine your approximate geographic location or ISP. Do not share your real name, address, or financial information on camera.
- No Background Checks: We do not conduct criminal background checks or identity verification on our free users. You are solely responsible for taking appropriate safety precautions.
4. Moderation, Monitoring, and Enforcement
While ChatRandom does not have a general obligation to monitor all communications, we reserve the right to enforce these Terms aggressively.
We employ a hybrid moderation system consisting of automated Artificial Intelligence (AI) and human reviewers. Our AI systems may periodically sample randomized, encrypted frames from active video streams to detect prohibited conduct (such as nudity in non-adult sections, illegal imagery, or underage users). If a violation is detected, your connection will be severed, and your IP address may be banned temporarily or permanently at our sole discretion.
Furthermore, we reserve the right to cooperate fully with law enforcement authorities or court orders requesting or directing us to disclose the identity, IP address, or connection logs of anyone publishing or broadcasting materials that are believed to violate applicable laws.
5. Intellectual Property Rights
Our Property: The ChatRandom name, logos, website design, matchmaking algorithms, and all related code and intellectual property are the exclusive property of ChatRandom US and its licensors. You are granted a limited, non-exclusive, non-transferable license to access the platform for personal, non-commercial use.
User Content: You retain ownership of the video and audio you transmit. However, you grant ChatRandom a temporary license to route, process, and transmit this data strictly for the purpose of facilitating the P2P connection and running our moderation algorithms.
No Recording: You are strictly prohibited from screen recording, capturing screenshots, or otherwise broadcasting the video streams of other users without their explicit, on-camera consent. Doing so is a violation of their privacy and these Terms.
6. Disclaimers and Limitation of Liability
DISCLAIMER OF WARRANTIES: THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. CHATRANDOM EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, LAG-FREE, SECURE, OR ERROR-FREE.
LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CHATRANDOM, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; OR (III) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
7. Indemnification
You agree to defend, indemnify, and hold harmless ChatRandom and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of: (a) your use and access of the Service, by you or any person using your device/IP; (b) a breach of these Terms; or (c) your violation of any third-party right, including without limitation any right of privacy or intellectual property rights.
8. Dispute Resolution and Governing Law
Governing Law: These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in San Francisco, California before one arbitrator. The arbitration shall be administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures.
Class Action Waiver: YOU AND CHATRANDOM AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
9. Modifications to the Service and Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We also reserve the right to modify, suspend, or discontinue the Services (or any part thereof) at any time without notice. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
